Students with disabilities are frequently accused of disciplinary infractions. New Jersey and federal laws afford special needs students certain protections for these infractions. For example, under certain circumstances, the district must conduct a “manifestation determination hearing.” The purpose of this is to determine whether or not the action for which the student is being disciplined is linked to their disability.

You are also entitled to appeal disciplinary determinations. These laws also protect students who have disabilities that have not yet been identified by the school district.
